TERMS AND CONDITIONS

These Terms and Conditions form the basis of Dining Plus Program operated by Derby Marketing L.L.C. and are effective from the date of issuance of the Dining Plus membership card (hereafter referred as card). By using the Card, you agree to the Terms & Conditions. Dining Plus reserves the right to vary, amend or make any changes to these Terms & Conditions from time to time without prior notice in its absolute discretion.  Any changes will be communicated on our website and become effective at the time of posting on our website. 

DINING PLUS

SERVICES AGREEMENT

THIS SERVICES AGREEMENT (“Agreement”) is entered into by and between Derby Marketing LLC (“Dining Plus”) and the “Customer” (“the Party/Parties”) who agree as follows:

1.     Definitions:

Capitalized terms are used as defined in this Agreement.

means UAE Dirhams.

ADDITIONAL CHARGES means the charges incurred by the Customer for carrying out any Additional Services not included in the Service Charge.

ADDITIONAL SERVICES means any extra or additional services which the Customer requires not covered within the Services and which will be charged to the Customer.

Applicable Law(s)” means (i) all legislation including codes, decrees, resolutions, acts, statutes, ordinances, rules, regulations, directives, and other orders, treaties, by-laws, codes of practice and other subordinate legislation of the UAE; and/or (ii) the requirements, rules and regulations of any authority, including without limitation, local, regional, territorial, free zone, municipal government, ministry, governmental department, commission, executive, administrative or judicial bodies in the UAE;

COMMENCEMENT DATE means the date the Services are commenced.

EMPLOYEE means an individual employed by Dining Plus to perform the Services for the Customer.

SERVICES means the Services to be performed by Dining Plus as purchased by the Customer. 

TERM means the period from the Commencement Date that the Customer requires/purchases Services from Dining Plus until completion.

“UAE” means United Arab Emirates and Dining Plus’s country of domicile

2. Commencement and Provision of Services:

2.1 This Agreement shall come into effect on the Commencement Date and shall continue for the duration of the Term unless terminated in accordance with Clause 11.

2.2 Dining Plus shall provide the Services to the Customer in accordance with the terms and conditions of this Agreement.

2.3 The Dining Plus card cannot be duplicated and/or used for any purposes other than those provided in these terms and conditions.

2.4 This Agreement shall form the sole basis on which the Services shall be provided to the Customer.

2.5 All Services can be purchased via www.diningplus.ae and will be delivered to the address or location specified by the Customer.

2.6 All persons using and purchasing the Services on Dining Plus website at www.diningplus.aemust be over 18.

3. Payment of Service Charges:

3.1 The Customer will, in consideration of the Services provided by Dining Plus, pay the Service Charge.

3.2 The Customer will receive delivery confirmation of all purchases made online via www.diningplus.ae by email.

3.3 If Dining Plus incurs any additional cost or expense outside Dining Plus’s control as a result of any new, existing or amended Applicable Law or as a result of compliance with any new, existing or amended Applicable Law whilst carrying out any of the Services, the Customer shall be obliged to reimburse Dining Plus all such additional costs or expenses and the Customer agrees to the Service Charge being revised accordingly.

4. Dining Plus Responsibilities:

4.1 Dining Plus will deploy Employees that meet the technical and other skills required to perform the Services.

4.2 Dining Plus shall provide standard tools and equipment necessary for the completion of the Services.

4.3 In the event that Services cannot be performed due to adverse weather conditions, Dining Plus will reschedule the Services at no additional cost to the Customer.

5. Customer’s Responsibilities:

5.1 Partner reserves the right to add/delete/change the promotions/offers as well without notice.The changes shall be reflected on the website www.diningplus.ae.

5.2 The Discounts must be used before the membership expiry. A member is eligible to get the discounts on the website www.diningplus.ae

5.3 Member has to visit the website to check the discount offers.

5.4 Dining Plus is not responsible for the quality of goods and/or services provided by the partner.

5.5 Dining Plus reserves the right to suspend or change services without notice. 

5.6 For Zomato Gold terms of use, please refer to the terms stated here.

  • The Zomato voucher code is valid only for 1 month from the membership start date.
  • How to get Zomato code:-    

                    ► On receiving the Dining Plus package the customer needs to register the Dining Plus card and setup the login Credentials.

                    ► Sign in with the credentials.

                    ► On the dashboard ,click on the Zomato Membership Request Button.

                     ► Zomato code will be sent on the registered email id of the customer.

  • Please find below the steps to activate your Zomato Gold membership Code:

            ► Open Zomato App.

            ► Select Gold icon.

            ► On the plan page, enter code under the “Enter Activation Code” section and click “Apply Code”.

            ► In case you face any difficulty in redeeming this voucher code please write to: gold@zomato.com     

        5.7  For 1 Night UAE stay terms of use, please refer to the terms stated below

            5.7.1 For 1 Night UAE stay terms of use for Platinum and Platinum plus, please refer to the terms stated here

5.7.2 For 1 Night UAE stay terms of use for Gold Plus and Premium package, please refer to the terms stated below:  

  • Stay is for a couple and 1 child below 12 years.
  • 1 night stay can be availed on the below hotels.

    • Golden Tulip Khatts Spring and Spa
    • Abu Dhabi - Al Diar Capital Hotel
    • Fujairah – V Hotel

    • Umm Al Quwain-Barracuda Beach Resort (Excluded for Thursday and Friday)

Note for Gold Plus members: Booking at Mercure Grand Hotel can be done with an additional charge of AED 125, Novotel - AED 75 which has to be paid to Dining Plus before confirming the booking. Stay at Mercure Grand Hotel can be availed from Saturday to Wednesday. The stay at Mercure Grand hotel can be booked by 2 adults and 2 children below 12 years.

Stay at Mercure Grand Hotel can be availed from Saturday to Wednesday. The stay at Mercure Grand hotel can be booked by 2 adults and 2 children below 12 years.

    General Terms & Conditions

  • The stay is for 2 adults and one child below the age of 12 years with complimentary breakfast.
  • Booking must be requested minimum 7 working days in advance.
  • You can avail the stay during the membership period only. The stay can only be booked on the name of the member and is strictly non-transferable. Bookings are subject to availability.
  • Any service request has to be done from the registered email id.
  • As per U.A.E government regulation, Tourism Dirham fee and 5% VAT will be applicable and will be paid by the member at the time of check-in directly to the hotel.
  • 1 Night Stay in U.A.E is not applicable on Religious, Public, National or any theme holidays at the discretion of the Hotel.
  • Dining Plus reserves the right to suspend or change services without notice.

5.8 For 3 Days 2 Night international stay in India or Far east terms of use, please refer to the terms stated here.

         5.9 Concierge Service

  • Airport Transfers /Point-to-Point transfer:-

Terms and Conditions for Airport transfers / Point-to-Point Transfers:-

  • All requests should be made 2 working days prior to the service date. Requests received between 08.30 am to 05.00 pm from Saturday to Thursday (excluding public holidays) will be accepted. Requests received after 05.00 pm will be actioned the following working day.
  • Only valid Dining Plus members can request for complimentary Airport transfers depending on their membership validity and eligibility of services.
  • The Point to Point service can be provided within the city limits of Dubai, Abu Dhabi and Sharjah only. Inter Emirate services are not provided, however, in case a member requests for an Inter-Emirate service, it will be charged to the member.
  • To avail this service, the member must provide valid membership details.
  • Waiting time for chauffer is 45 minutes (at the Airport Pickup) and 30 minutes  (from Residence/Service location) from the requested timing on the form.
  • For airport drops, we recommend members must request service timing at least 3 and half hour before scheduled flight timing to avoid delays.
  • Customers can cancel a service 24 hours prior to the stipulated service time. Any cancellation within 24 hours of the stipulated service time, will be considered as a no show.
  • A No-Show will be counted as one service utilized.
  •  Car Registration:-

Terms and Conditions for Car Registration:-

  • All requests should be made 2 working days prior to the service date. Requests received between 08.30 am to 05.00 pm from Saturday to Thursday (excluding public holidays) will be accepted. Requests received after 05.00 pm will be actioned the following working day.  
  • On booking of service, the car will be picked up between 09.00 am to 05.00 pm and the registration will be completed within the same time period.
  • The Car Registration can be provided within the city limits of Dubai, Abu Dhabi and Sharjah only. Inter Emirate service will not be provided.
  • The complimentary service through the Support Desk is only for pickup and delivery of car/documents to and from the RTA office. All RTA charges with respect to car registration will be charged directly through a credit card authorization form.
  • If the member's car fails the car registration process for any reason whatsoever, the documents and the car will be returned back to the member and the service will be considered as redeemed.
  • Fines and black points, if any, should be cleared before requesting for service.     
  • Required documents include original/copy valid insurance policy, original registration card passport copy with visa page and Emirates ID.

 

  •  Messenger services:-

Terms and Conditions for Messanger services:-  

  • All requests should be made 2 working days prior to the service date. Requests received between 08.30 am to 05.00 pm from Saturday to Thursday (excluding public holidays) will be accepted. Requests received after 05.00 pm will be actioned the following working day.
  • Pick Up and Delivery services will be provided within city limits of Dubai, Abu Dhabi, and Sharjah only. In case a member requests for an Inter-Emirate service, it will be charged to the member. 
  • Only documents up to 500 grams will be accepted for delivery. The Support Desk has the right to refuse delivery if the contents are not documents.
  • The package will be accepted only if documents are provided in a sealed envelope with the name, address and contact number of both the sender and receiver clearly mentioned on the envelope
  • If the package is not accepted for delivery by the receiver, the attempt will still be counted as a service and the package will be returned to the sender.

5.10 The Customer acknowledges that they are responsible for maintaining the confidentiality of their online account

5.11 In the event that Dining Plus will have to carry out Additional Services in order to complete the Services, Dining Plus will notify the Customer as soon as practicable for authorization and the Additional Services will be charged to the Customer as Additional Charges.

6. Warranties and Representations:

Dining Plus represents, warrants and covenants that:    

6.1 It shall provide 1-year membership to the customers who purchased the membership.

6.2 The execution, delivery or performance of this Agreement does not violate any law, regulation, rule, order, decree, injunction or other restriction of any governmental entity, court or tribunal to which it is subject or any of the provisions of its memorandum and articles of association; Nations, regional or national trade or financial.

6.3 Each Party represents, warrants and covenants that it will comply with all Applicable Laws in connection with this Agreement.

7. Indemnification: 

7.1 The Customer hereby undertakes to indemnify Dining Plus and to keep Dining Plus indemnified fully at all times against all claims, demands, actions, proceedings, damages, losses, costs and expenses (including legal and other professional adviser’s fee) which are made or brought against or inc
